Maine Uniform Building and Energy Codes Public Hearing and Comment Period Notification

The Technical Building Codes and Standards Board has in accordance with its mission, recently adopted the first statewide Building and Energy Code for the State of Maine.

These documents have been reviewed by the Attorney General’s Office for form and legality in keeping with the Maine Administrative Procedures Act as well as by the Secretary of State’s Office. They are also posted on the Bureau of Building Codes and Standards website at www.maine.gov/dps/bbcs

July 26th is the date for a formal Public Hearing on these proposed rules. This hearing will be held at the Department of Public Safety, 45 Commerce Drive, Augusta in the Fallen Heroes Conference Room at 1:00 p.m.

Anyone is welcome to testify at the Public Hearing and is requested to also bring a copy of their testimony in written format, to be submitted to the Board at that time. The deadline for public comment is Thursday, August 5, 2010.


The attached letter was sent out this week expressing the Association's concerns about the new State Plumbing Code and the need for municipalities to purchase a copy of it if they want one.

MBOIA members attend ICC Annual Conference

MBOIA was well represented at the 2009 ICC Conference and Code Hearings.  Those in attendance were: President Tim Nelson, Vice President Dick Lambert, Board Member Mike Nugent and member Dan Wellington.  The conference included election of officers, two days of education sessions, various opportunities for interaction with code officials from throughout the country and the world and, of course, the first round of code change hearings that will form the basis for the 2012 editions of the I-Codes.

MBOIA lends support to LiDAR Grant Application


The Technical Building Code and Standards Board is now accepting applications for persons interested in applying for a position on any of the Technical Advisory Groups (TAGs). 

If you are interested in serving on any of these groups, please fill out the application and send it to tjnel@securespeed.us.The Board would like to send these along to the State with a letter of support, that is why we are asking for the applications to be sent to us first.  If you are interested in what the Maine Uniform Building and Energy Code looks like, please volunteer to serve on one of these groups.

“Subsurface Wastewater Disposal System Permit Surcharge Now in Effect!

That State Legislature, during its budget deliberations this year, decided to fund the Water Quality Improvement Fund by enacting several surcharges.  One of those surcharges is a $15 charge to all non-engineered subsurface wastewater disposal systems permitted after July 1, 2009.  Unfortunately very few people knew about this surcharge until Russ Martin sent out a newsletter to all LPIs last week. 

After a discussion with Russ and Andy Fisk from the Maine DEP, the letter found at this link was generated so that our membership could be made aware of this change.  Please note that they are asking that we start collecting this money “as soon as possible” and that it is not necessary to seek back payment for systems already permitted since July 1.  Please note the special instructions on how to remit the surcharge to the State.

Code Enforcement Training and Certification Program Back on Line.”

If you didn’t receive the email from the State Planning Office regarding the reactivation of the CEO Training & Certification Program, don’t worry!  Here it is:

Good Morning,

I am writing to inform you that the code enforcement program at the State Planning Office is gearing up again after a brief hiatus due to budget restrictions. I will be overseeing the program. I have a BA in Communication and spent the past 7 years working at the Maine Mathematics and Science Alliance as their Communications Coordinator. I helped track the certification of math and science teachers in the state of Maine and coordinated events nationwide.

The CEO program is returning, but with some changes which are detailed below. We are working to create a program that focuses on basic training, which is our primary statutory directive. As we look at the program and its alterations I will keep you up to date with information.

  • SPO will no longer be providing technical assistance. If you have questions we can direct you to a person or office where you can find the answers you need.
  • SPO will only be offering basic and 80K training, we will no longer provide advanced training.
  • The number of trainings offered per year by SPO will be scaled back.
  • Law changes now allow us to extend certifications and even suspend the program again if revenues are not sustained.
  • SPO will be making greater use of electronic and web-based media.

In order to ease this transition, the number of years that your certification is valid for has been increased from 5 years to 6 years. This will give you more time to become re-certified.
I will be emailing certificates and certification cards with your CEO and LPI new expatriation date (one year more than what your document currently states). If you are a new hire since January 2009, please contact me regarding your certification status.

Thank you for your patience as we restructure this program to adjust to declining revenues. I look forward to working with you.
